Terms Of Use

I. GENERAL PROVISIONS

1. These rules are valid for the purchase of AKUKU UAB (hereinafter referred to as AKUKU) online store located at akukuuniform.lt.

2. The AKUKU can change the rules of the shop at its discretion and without prior notice. When a customer purchases from the store, the rules that apply at the time of placing the order are applicable.

3. The customer confirms that he / she is familiar with the store rules when submitting a goods order. In cases where the client partially or completely disapproves of all or some of the rules, he/she must refuse the order, otherwise the customer is deemed to have read and unconditionally accepted all the store rules.

4. AKUKU is exempted from any liability in cases where the loss arises from the fact that the client despite of recommendations and his obligations did not understand the rules of the shop although he/she was given such a possibility.

 

II. PRIVACY POLICY

1. AKUKU takes care of customer privacy and protects customer personal data. AKUKU strives to make shopping at the shop at www.akukuuniform.lt as convenient as possible for the client, and to make the customer’s orders as smooth and timely as possible. The implementation of this goal requires the accurate customer information.

2. The customer’s personal information is collected by AKUKU at the ordering of the goods at the shop www.akukuuniform.lt and by requesting additional information about products, orders, their processing, etc. Also, when subscribing newsletters.

3. By submitting your data, the customer agrees with the company’s Privacy Policy.

4. If the customer does not agree with the rules of this Privacy Policy, then AKUKU asks you not to provide your personal data processing, and to purchase goods at AKUKU physical store, at Stikliu str. 16, Vilnius.

5. When ordering goods, the customer must specify the personal data necessary for the delivery of the goods, i.e.: name; surname; the exact address and postal code on which the goods will be delivered; contact telephone number; E-mail; other data necessary for delivery. AKUKU undertakes to store this information and not disclose it to third parties, except for the partners of AKUKU, which provide delivery services or other services related to the provision or execution of a client order. Exceptions to any other personal disclosure of client information to third parties are in all cases coordinated with the client. In all other cases, any personal data of the client may be disclosed to third parties only in cases provided for in the legal acts of the Republic of Lithuania.

6. When ordering goods at www.akukuuniform.lt , the customer confirms their full age and has the right to order goods at the AKUKU store.

7. Upon familiarity with the rules, the client confirms that he/she is informed that when browsing the store at www.akukuuniform.lt, the cookie files will be placed on the client computer, i.e. files that are sent from the web server.

8. AKUKU confirms its commitment to using state-of-the-art technology for protecting customer personal data.

 

III. ORDER SUBMISSION PROCEDURE

1. The customer chooses the goods he likes in the AKUKU online store. His/her choice is based on a basket of goods.

2. Once the goods basket has been formed, the customer must enter the data necessary for the delivery: name, surname, exact address, the phone and additional information that may be relevant for the delivery of the ordered goods. AKUKU confirms that the data provided by the client will be used on the basis of the Privacy Policy, without prejudice to the requirements for the protection of personal data provided for in the legal acts of the Republic of Lithuania.

3. Next, the Client must choose one of the possible ways of payment to the AKUKU online store.

4. In the last window, the final amount of the customer order is generated, before the confirmation, the client must verify that the submitted data is correct and in accordance with his/her wishes. The customer has the opportunity to correct the false data before sending the order to the AKUKU. The customer is also given the opportunity to adjust the personal data necessary for delivery of the goods, even after the order has been submitted. If the customer is not familiar with the Rules before choosing the goods, he/she must do so before confirming his order and before submitting his data.

5. After the client confirms the order, its will be sent to the AKUKU. The order is deemed to be submitted from the moment it is received by the AKUKU. In this case, it is considered that there is an agreement between the Client and the AKUKU. However, such an agreement is deemed to be enforceable only from the moment when AKUKU receives confirmation from the client of the chosen bank about the payment for the ordered goods.

6. After the customer has submitted an order, the AKUKU system automatically sends an e-mail, which specifies the ordered goods and the data provided by the customer, as well as all the necessary information to pay for the goods by bank transfer.

7. Upon receipt of a notification from the bank that the customer has made a payment order for the purchase of goods from the AKUKU online store, the customer’s order and contact information are transferred to the partners of AKUKU. The receipt of a notification from a bank is considered to be the moment when the agreement between the Client and the AKUKU is executed.

8. The order submitted by the Customer is stored in the AKUKU database in accordance with the requirements of the valid legislation of the Republic of Lithuania regarding the term of such data storage.

9. In all cases, the customer is deemed to be familiar with and unconditionally accepting all the rules of the AKUKU Online Store, as with any other terms specified in the order, when placing an order.

10. The contract is concluded and executed in the state language of Lithuania.

 

IV. GUARANTEE AND DETERMINATION OF GOODS PRICES

1. The characteristics of each item are listed collectively with each item in the Store. If there is no description, the customer may contact the AKUKU by email and receive additional information.

2. The AKUKU indicates and the customer confirms their awareness that the goods indicated in the AKUKU online store may not match to the actual size, shape and color of the goods, due to the characteristics of the monitor used.

3. The Client agrees that by submitting his/her order electronically to the AKUKU online store, he/she undertakes to pay the price for the goods indicated on the order.

4. Prices in the Shop and on the invoice are indicated in Euro with VAT.

5. The AKUKU sells goods that meet the conditions set out in the order. In cases where the goods transferred to the customer do not comply with certain requirements of the order, the customer agrees to immediately notify the AKUKU by telephone or by e-mail.
The company undertakes to take all actions to eliminate existing deficiencies if such defects arise from the fault of the company or third parties acting on its behalf. If the company does not eliminate defects within the deadline agreed with the client, the client has the right to defend his/her interests in accordance with the procedure provided for in the Civil Code of the Republic of Lithuania.

6. Liabilities of the AKUKU:

6.1. The company undertakes to transfer goods of the appropriate quality and meet the requirements specified in the order.

6.2. AKUKU undertakes to provide the customer with the quantity specified in the order.

6.3. AKUKU In all cases provides the customer with a range of products that meet the criteria specified in the order.

6.4. Delivered goods are packed according to their nature in order to make the goods suitable for their intended use.

 

V. PAYMENT PROCEDURE AND TERMS

1. The customer will pay for his ordered goods by bank transfer, by the bank’s payment card Paysera or through the PayPal system. AKUKU operates the following payment cards issued by banks: VISA, Visa Electron, MasterCard.

2. When the customer chooses the payment method for the ordered goods, it is automatically redirected to the billing page, which must contain the necessary information for the payment to be made.

3. The customer undertakes to pay for the ordered goods immediately, otherwise he/she loses the right to make claims regarding violation of delivery terms. AKUKU starts packing goods only after receiving payment for them.

4. Invoices for purchased goods in the AKUKU online store are issued only upon receipt of confirmation from the bank of the payment made and sent to the customer at the e-mail address given to him.

 

VI. RETURN AND REPLACEMENT OF GOODS

1. The customer may return the purchased goods by notifying the AKUKU in writing within 14 calendar days from the date of delivery.

2. Replaced or returned quality goods must meet the following criteria:

2.1. The goods must be not to worn and without external wearing signs (this criteria does not apply to the return of a defective product);

2.2. Each return item must be packed in suitable packaging to prevent damage during transportation;

2.3. The goods must not be damaged;

2.4. Returned goods must be labeled with all product labels and have their merchandising appearance.

3. If the goods are made according to the client’s individual order or obviously adapted to the client they are not changed and can not be refunded (the money paid for such goods is not returned to the customer).

4. An alteration in the appearance of the product or its packaging, which was necessary for the inspection of the item received, can not be regarded as a material change in the appearance of the item.

5. When the reason for the return of the goods is inadequate quality, AKUKU undertakes to change the goods of inappropriate quality at its own expense or to return the money paid for the goods. Inappropriate quality goods are changed or returned in accordance with the “Rules for the return and exchange of goods, approved in 2001 June 29, by the Minister of Economy Order No. 217 “.

6. The customer who has received the product of inappropriate quality shall submit a written request to AKUKU, which indicates the defects of the product and their desire to change the product or return the money paid for that product.

7. In all cases, upon returning the goods, the customer must provide a document confirming the purchase of the goods (invoice, cash receipt or payment statement).

8. In order to return the item, the customer must inform the AKUKU by the e-mail (to the address info@akuku.lt ). Return of the item is performed by filling the form provided by AKUKU. The form must indicate the return item and the reason for the return.

9. The amount of money paid is returned to the customer not later than within 5 business days after the return of the goods. The money is transferred to a bank account, which the customer must specify on the return form.

10. If goods are returned or exchanged for a quality item matching the client’s order, the delivery fee will not be refunded to the customer and will not be reimbursed.

11. AKUKU has the right not to accept the goods returned by the customer if the customer does not comply with the established procedure of the return of goods.

 

 VII. DELIVERY OF GOODS

1. The goods are delivered by AKUKU through authorized representative (courier) throughout Lithuania, Latvia and Estonia. Goods to other countries are sent by registered mail.
2. If the item is in stock, AKUKU will deliver it within 2-4 business days from the date of purchase. If the product needs to be manufactured then it will take two weeks from the beginning of the purchase of the item.

3. The production of exclusive goods and school uniforms can take up to 2 months. In this case, the AKUKU customer will be informed by e-mail about production and delivery terms.

4. The customer undertakes to specify the exact shipping address, contact number and the person who will accept the goods when ordering the goods.

5. The customer undertakes to accept the goods himself. In the case that he/she can not accept the goods himself, and the goods are delivered to the specified address and on the basis of other data provided by the customer, the customer is not entitled to express the claims to AKUKU regarding the delivery of the goods to an unfit entity.

6. The Client must immediately inform the AKUKU by e-mail if the received batch is presented in a damaged, melted or otherwise damaged package; as well as in cases where the item contains not ordered goods or inappropriate quantity of goods, incomplete set of goods, inappropriate size goods.

7. Delivery price in all Lithuania, Latvia and Estonia depends on courier rates. The delivery of goods for more than 100 EUR is free of charge, except for the Curonian Spit.

8. Also, the goods can be withdrawn at the AKUKU studio at Stikliu str. 16, Vilnius, on working days from 9:00 am to 18:00 pm. In all cases, we recommend calling us before arriving by phone: +370 607 48 081, or by email (info@akuku.lt).

 

VIII. OTHER PROVISIONS

1. All messages to the AKUKU must be submitted by e-mail (info@akuku.lt ).

2. The contract is concluded, executed and all communication between the Client and the AKUKU is conducted in the state language of the Republic of Lithuania.
